{"id":1536,"date":"2009-12-17T10:24:34","date_gmt":"2009-12-17T17:24:34","guid":{"rendered":"http:\/\/www.bismancafe.com\/blogs\/?p=1536"},"modified":"2025-08-06T13:43:10","modified_gmt":"2025-08-06T18:43:10","slug":"remembering-the-wal-martdans-supermarket-controversy","status":"publish","type":"post","link":"https:\/\/www.bismarckcafe.com\/blogs\/1536\/remembering-the-wal-martdans-supermarket-controversy","title":{"rendered":"The Wal-Mart\/Dan&#8217;s Supermarket Controversy of the 1990s"},"content":{"rendered":"<p><a href=\"http:\/\/www.bismancafe.com\/blogs\/?attachment_id=1543\" rel=\"attachment wp-att-1543\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-full wp-image-1543\" title=\"Dan's Supermarket &amp; Wal-Mart logos\" src=\"http:\/\/www.bismancafe.com\/blogs\/wp-content\/uploads\/2009\/12\/dans-walmartlogos.jpg\" alt=\"Dan's Supermarket &amp; Wal-Mart logos\" width=\"250\" height=\"188\" \/><\/a>We all have now grown accustomed to grocery shopping at Wal-Mart, but when the national retailer first arrived in Bismarck back in 1990, its\u00a0sale of grocery-related\u00a0merchandise caused legal tensions between the national retailer and long-time local grocer <a title=\"Dan's Supermarket \/ Supervalu\" href=\"http:\/\/www.bismancafe.com\/blogs\/?page_id=131\">Dan&#8217;s Supermarket<\/a>, who had previously\u00a0purchased the adjacent parcel with intentions of constructing a new store of its own.<\/p>\n<p>Despite opening nearly five years after Wal-Mart, Dan&#8217;s had purchased its parcel of land from <a title=\"Wachter Family\" href=\"http:\/\/www.bismancafe.com\/blogs\/?page_id=323\">Wachter Trust<\/a> back in 1987 &#8211; two years prior to Wal-Mart&#8217;s purchase. As a condition of the sale,\u00a0a\u00a0clause was added\u00a0restricting a direct\u00a0grocery competitor from\u00a0developing on the adjacent parcel, which was\u00a0still owned by Wachter Trust at the time.<\/p>\n<p>This type of condition is actually\u00a0quite common amongst businesses when either purchasing or leasing sites, and even sometimes demanded by city governments to prevent too many of the same types of businesses operating within close proximity of each other.<\/p>\n<p>When Wal-Mart purchased the adjacent parcel in 1989, the national chain had been aware of the provision, however chose to still move forward in constructing a store on the site. When the Wal-Mart store opened the following year, it did indeed feature grocery and other food-related\u00a0merchandise banned in the clause.<\/p>\n<p>Even though Dan&#8217;s had yet to build a store on the adjacent lot, the company enacted its right to\u00a0enforce\u00a0the\u00a0provision\u00a0and prevent Wal-Mart from selling such merchandise.<\/p>\n<p>At first, Dan&#8217;s was victorious in its legal action against Wal-Mart, since it had filed the appropriate paperwork listing the restriction.<\/p>\n<p>In 1994, Wal-Mart won\u00a0an appeal against Dan&#8217;s Supermarket, legally granting the company permission to continue selling grocery and food-related\u00a0items, provided it did not operate a full-line grocery store on the site.<\/p>\n<div id=\"attachment_1552\" style=\"width: 210px\" class=\"wp-caption alignright\"><a href=\"http:\/\/www.bismancafe.com\/blogs\/?attachment_id=1552\" rel=\"attachment wp-att-1552\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1552\" class=\"size-thumbnail wp-image-1552\" title=\"Dan\u2019s Supermarket on South Washington Street\" src=\"http:\/\/www.bismancafe.com\/blogs\/wp-content\/uploads\/2009\/12\/3069859968_9e992f0be7-200x150.jpg\" alt=\"Dan\u2019s proceeded with its plans to develop a new store on the site just south of Wal-Mart, opening in June 1995.\" width=\"200\" height=\"150\" \/><\/a><p id=\"caption-attachment-1552\" class=\"wp-caption-text\">Dan\u2019s proceeded with its plans to develop a new store on the site just south of Wal-Mart, opening in June 1995.<\/p><\/div>\n<p>Despite this minor setback, Dan\u2019s continued with its plans to develop a grocery store on the adjacent site, opening in June 1995. Their new store, which replaced its store located just north of <a title=\"Kirkwood Mall\" href=\"http:\/\/www.bismancafe.com\/blogs\/?page_id=201\">Kirkwood Mall<\/a>, was the first to be specifically branded as Dan\u2019s \u201cSupermarket\u201d\u00a0as opposed to \u201cSupervalu\u201d.<\/p>\n<p>Ironically enough, Wal-Mart has since opened two brand-new\u00a0super centers, with each of them featuring a full-line grocery department. This came\u00a0barely ten years after its\u00a0original store was granted legal permission to sell just a small handful of grocery items. The former Wal-Mart building now houses <a title=\"Runnings Farm &amp; Fleet\" href=\"http:\/\/www.bismancafe.com\/blogs\/?page_id=286\">Runnings Farm &amp; Fleet<\/a>.<\/p>\n<p>Wal-Mart was Bismarck&#8217;s fourth modern-day discount department store when it opened in 1990, after Kmart (1971), <a title=\"Thrifty White Drug \/ White Mart\" href=\"http:\/\/www.bismancafe.com\/blogs\/?page_id=321\">White Mart<\/a> (1979), and Target (1980).<\/p>\n<p>If I remember correctly, the friction between Wal-Mart and Dan&#8217;s Supermarket caused another stir when one of the retailers had wanted to install a connection between the other&#8217;s parking lots.
